What are the penalties for non-compliance in Return to Work?

Most workers and employers cooperate in the Return to Work (RTW) process. Those who do not cooperate may be penalized.

You may be penalized if the WSIB determines that you are not fulfilling your re-employment obligations.

• You can be fined up to the equivalent of the worker’s net average earnings for the year before the injury, and
• The WSIB may make payments to the worker, as if the worker were entitled to loss of earnings (LOE) benefits.

Workers may have their loss of earnings benefits reduced, suspended, or stopped if the WSIB determines that they are not co-operating in the RTW process.
